شيوه‌هاى مثبت غير خشن را براى نظم و انضباط در مدرسه معرّفى كنند، استقبال مى‌كند.» [١] هم‌چنين، كميته‌ى حقوق اقتصادى، اجتماعى و فرهنگى، با در نظر داشتن مادّه‌ى ١٠ ميثاق حقوق اقتصادى، اجتماعى و فرهنگى، و در برخى از گزارشات نيز بدون اين‌كه به مادّه‌ى خاصّى اشاره داشته باشد، حكم كرده است: مجازات و تنبيه بدنى توسط والدين غير مجاز (ممنوع) و قابل اعتراض است. [٢] از اين رو، اين مطلب را ذيل مادّه‌ى ١٠ به عنوان منبعى براى ممنوعيّت ضمنى تنبيه و مجازات بدنى كودكان توسط والدين استفاده كرده‌اند.

٥. كنوانسيون اروپايى حمايت از حقوق بشر و آزادى‌هاى اساسى‌ [٣]

پس از اسناد بين‌المللى كه به ممنوعيّت تنبيه بدنى كودكان اشاره داشتند، برخى از اسناد منطقه‌اى نيز به اين مطلب توجّه داشته و ممنوعيّت تنبيه بدنى كودكان از آن‌ها قابل استنباط است. از جمله اين اسناد، كنوانسيون اروپايى حمايت از حقوق بشر و
