Messenger of God (peace be upon him and his progeny), this very Prophet, and the Quran, this very Quran, they both permitted two types of muta during the Prophets time, and I prohibit both of them and I shall punish anyone practicing them. One of them is the mut a of women. I shall not enable any person to marry a woman for a fixed period but that I shall cover him with stones."٥٧

٦. A tradition is narrated by Ata. He said:

Jabir b. AbdAllah returned from Mekka, having performed the lesser pilgrimage. We came to his house to see him and the people asked him about certain things. Then they mentioned al-muta. He said, "Yes, we sought contentment during the time of the Prophet and Abu Bakr and Umar."٥٨

This same tradition is reported by Al)mad b.J:Ianbal in hisMusnad, and he added, "... until toward the end of the caliphate of Umar."٥٩

٧. A tradition is related by Imran b. Hu ayn.

The verse regarding the muta was revealed in the Book of God, the Blessed, the Ex‌ alted. And we followed it with the Prophet, and no verse was revealed to abrogate it, nor did the Prophet prohibit it, until he died.٦٠

This tradition has also been reported by al-Razi in his commentary on this verse in which he adds, "At that time, a man did what he desired [concerning this matter], in accordance with his personal opinion."٦١

٨. A tradition was reported on the authority of AbdAllah b. Masud:

He said, "We were on an expedition with the Messenger of God, and there were no women with us. So we told the Prophet, Should we emasculate ourselves? He for‌ bade us that. Then he permitted us to marry a woman for a fixed period in exchange for a garment." Then AbdAllah recited, "٠ you who believe! Forbid not the good things which God has made lawful for you, and transgress not. Lo! God loves not trans‌ gressors" (Q. ٥:٨٧).٦٢

It must be pointed out that the reciting of the verse by AbdAllah clearly estab‌ lishes that the prohibition of muta was neither from God nor from the Prophet. It was, rather, something which occurred after the Prophets time.
٩. A tradition is reported by Shuba on the authority of al-J:Iakam b. Uyayna. He said: I asked him [al-l:lakam] about this verse, that is, the muta verse, whether it was abro‌
gated. He said, "No." AI-I:Iakam said, Ali said that had it not been for Umars prohi‌
bition of the muta, no one would have committed adultery except a scoundrel."٦٣

Al-Ququbi reports the same tradition on the authority ofAta, who related it from
Ibn Abbas.٦٤
It is possible that the word al-shaqr (scoundrel) is used in this tradition to convey the sense in which it has been explained in the tradition related by Abu Hurayra He said:

The Prophet said, "No one except a scoundrel will enter the Fire." He was asked, "What is a scoundrel?" He replied, "He is the one who does not act in accordance with what is required in obedience [to God], and does not abandon acts of disobedience to God."٦S
