the person who has declined to accept the trust is not responsible for
it. However, the recommended precaution is that if possible, he
shouldlook after that property.
٢٣٤١.A person who gives something to another
person as trust can take it back as and when he likes, and one who
accepts a trust can return it to its owner as andwhen he likes.
٢٣٤٢. If a person dispenses with the custody of
the property deposited with him and cancels his undertaking he should
deliver the property to its owner or to theagent or guardian of its
owner as early as possible or inform them that he is not prepared to
look after it and if he does not deliver the property to them without
properexcuse and does not also inform them and it the property perishes
he should give its substitute.
٢٣٤٣. If a person who accepts some property by
way of trust does not possess proper place for keeping it, he should
procure such a place and should ate care of theproperty in question in
such a manner that the people may not say that he has been negligent in
looking after it, and, in case he places that property st a place which
is notsuitable for it, and consequently it is lost, he should compensate
for it.
٢٣٤٤. If a person who accepts s deposit is not
negligent in looking after it and is not also extravagant and by chance
the property perishes, he is not responsiblefor it. If, however, he
keeps it at a place where it is not safe from the clutches of a criminal
minded person who may become aware of it and take it away, and if
theproperty is thus lost, he should give compensation to its owner.
٢٣٤٥. If the owner of a property specifies a
place for its j custody and tells the person who has accepted the
deposit: "You should preserve the property here andeven if you consider
it probable that it may perish here, you must not take it elsewhere", he
cannot take it to another place and if he fakes it elsewhere and it is
lost heis responsible.
