pauper on account of Zakat, he should tell him that it is Zakat. Rather,
if the pauper feelsashamed of it, it is recommended that he should give
him property with the intention of Zakat. but should not mention that
it is Zakat.
١٩٤٤. If a person gives Zakat to someone under
the impression that he is a pauper and understands later that he was not
a pauper or owing to his not knowing therelevant orders, gives Zakat to
a person about whom he knows that he is not a pauper, it is not
sufficient (i.e. Zakat has not been paid properly). Hence, if the thing
whichhe gave to that person still exists, he should take it back from
him, and give it to the person entitled to it. And in case that thing
has perished, and the person, who tookit, was aware that it was Zakat.

person entitled to it. And in case he was not aware that it was theZakat
property, nothing can be taken from him, and the person, who has to pay
Zakat. should give it to the person entitled to it from his own

١٩٤٥. A person who is a debtor and cannot repay
his debt can take Zakat to repay it, though he may possess the means to
meet his expenses for the year. However. itis necessary that he should
not have spent the loan for some sinful purpose.
١٩٤٦. If a man gives Zakat to someone, who is
indebted and cannot repay his debt and understands later that he had
spent the loan on sinful acts, and if that debtoris a pauper the man can
adjust against Zakat what he has given him.
١٩٤٧. If a person is a debtor and cannot repay
his debt, although he is not pauper one can adjust against Zakat the
amount which that person owes him.
١٩٤٨. If the provisions for the journey of a
traveler are exhausted, or his animal of riding is disabled and his
journey is not a sinful one, and he cannot reachhis destination by
taking loan or selling something, he can take Zakat even though he
